What FieldFlow OS is
FieldFlow OS is a digital contractor management, communication, quoting, and marketplace platform. By accessing or using FieldFlow OS, you agree to all terms, policies, and conditions contained in this Legal Blueprint. If you do not agree, you must stop using the platform immediately.
FieldFlow OS is issued and operated within South Africa. These terms are governed by South African law and remain subject to any rights and duties that the law does not allow the parties to exclude.
What you agree to
By creating an account, accessing the platform, receiving messages, submitting information, or interacting with contractors or customers, you agree to the Terms & Conditions, Privacy Policy, POPIA Compliance Notice, Contractor Agreement, User Agreement, Safety Policy, and Dispute Policy. These documents collectively govern your use of FieldFlow OS.
Contractors work independently
All contractors listed on FieldFlow OS operate independently. They are not employees, agents, or representatives of FieldFlow OS. FieldFlow OS provides the platform and does not employ contractors, supervise their work, or guarantee their performance. Contractors are responsible for the services they deliver. Nothing here removes any direct right or remedy a customer may have against the contractor responsible for the service.
What the platform provides
FieldFlow OS is a technology platform. We provide communication tools, quoting tools, job management tools, business optimization tools, and marketplace visibility. We do not guarantee job availability, contractor quality, customer behaviour, earnings, or marketplace results. All interactions between contractors and customers occur at their own risk.
What we are not liable for
To the fullest extent permitted by law, FieldFlow OS is not liable for indirect or consequential loss, lost profit, lost business, contractor performance, customer behaviour, missed appointments, cancellations, or incorrect information supplied by users. Where liability may lawfully be limited, FieldFlow OS’s total liability is limited to the subscription fee paid for the current month. Nothing in these terms excludes liability for fraud, wilful misconduct, gross negligence, or any liability or consumer right that South African law does not permit us to exclude or limit.
Indemnity
To the extent permitted by law, you indemnify FieldFlow OS and its owners against third-party claims, reasonable legal costs, losses, or regulatory complaints caused by your unlawful conduct, your breach of these terms, information or content you supply, or services you provide. This indemnity does not apply where the loss was caused by FieldFlow OS’s fraud, wilful misconduct, gross negligence, or another liability that cannot lawfully be excluded.
Platform availability
FieldFlow OS may experience maintenance, outages, delays, third-party failures, network issues, or API interruptions. FieldFlow OS is not responsible for downtime or data loss.
Your information must be accurate
Users are responsible for providing accurate information, updating their details, and ensuring correctness of business and job data. FieldFlow OS is not responsible for incorrect or outdated information.
POPIA and your personal information
FieldFlow OS processes contact details, business information, job information, communications, billing records, and usage or security data where reasonably needed to provide and secure the platform, perform agreements, meet legal duties, support users, prevent fraud, and improve services. We do not sell personal information.
Information may be shared with carefully selected hosting, communications, payment, analytics, support, or professional service providers only where needed for those purposes and under appropriate safeguards. Where information is processed outside South Africa, FieldFlow OS will use safeguards required by POPIA.
Information is kept only as long as reasonably needed for the stated purpose, legal obligations, disputes, security, and legitimate record-keeping, then securely deleted or de-identified. Reasonable technical and organisational safeguards are used. If a security compromise creates a notification duty, affected people and the Information Regulator will be notified as required by law.
You may request access, correction, deletion, objection, restriction, or information about how your personal information is used, subject to lawful limits. Contact support@fieldflowos.net for privacy requests, the designated Information Officer’s details, or the complaints process. You may also complain to the Information Regulator of South Africa.
What contractors must do
Contractors must provide truthful business information, deliver services safely and professionally, comply with South African laws, avoid prohibited services, maintain accurate pricing, respond to customers promptly, and honour bookings and quotes. Violations may result in suspension or removal.
What customers must do
Customers must provide accurate job details, treat contractors respectfully, pay for completed work, avoid fraudulent behaviour, and use the platform responsibly. Violations may result in suspension or removal.
Safety rules
Contractors may not use FieldFlow OS for illegal services, dangerous or unlicensed activities, high-risk operations without certification, or fraudulent or misleading behaviour. FieldFlow OS may remove any contractor violating safety rules.
Fees, renewals, cancellation and refunds
FieldFlow OS may charge subscription, marketplace, payment processing, add-on, or boosted-listing fees. The price, billing period, and any automatic renewal are shown before purchase. Material fee changes will be communicated before they take effect.
You may cancel through the available account or support channel. Cancellation stops future renewal but does not automatically reverse charges already earned or services already supplied. Any cooling-off, cancellation, refund, or remedy required by the CPA, Electronic Communications and Transactions Act, or another applicable law remains available and takes priority over these terms.
Disputes
A complaint should first be sent in writing to support@fieldflowos.net with enough detail and supporting evidence for it to be assessed. FieldFlow OS will acknowledge it and respond within a reasonable period, taking the nature and urgency of the matter into account.
The parties must first try in good faith to resolve a platform dispute directly and may agree to mediation before court proceedings. FieldFlow OS may facilitate evidence submission, review, a platform decision, or refund logic within the platform’s scope, but does not replace a court, regulator, ombud, or a user’s statutory remedies.
Suspension and cancellation
FieldFlow OS may suspend or terminate accounts for fraud, abuse, misconduct, safety violations, non-payment, legal or security risk, or material breach of these terms. Where reasonable and lawful, notice and an opportunity to correct the problem will be given. Immediate action may be taken to protect users, the platform, or the public. Users may cancel their subscription at any time, subject to the billing and statutory-rights section above.
Consumer rights
If you qualify as a consumer under the CPA or other applicable law, mandatory protections remain in force. These terms must not be read as excluding a right, remedy, warranty, duty, or standard of service that cannot lawfully be excluded. If a term conflicts with such a protection, the legal protection applies and the remaining terms continue as far as possible.
Changes, notices and electronic communications
FieldFlow OS may update these terms for legal, security, operational, or service changes. Material changes will be brought to users’ attention before they take effect where required. You agree that platform notices and communications may be delivered electronically to the contact details on your account. Continued use after a valid change takes effect means acceptance only where the law permits; fresh active agreement will be requested where required.
General terms
You confirm that you are at least 18 years old and legally able to enter this agreement, or are acting with lawful authority for a business. These terms and the named policies form the complete platform agreement. If one provision is invalid or unenforceable, the rest remain effective. A delay in enforcing a right is not a waiver. You may not transfer your account or agreement without consent; FieldFlow OS may transfer the agreement as part of a lawful restructuring or sale, subject to applicable law and notice requirements.
Governing law
This Legal Blueprint is governed by the laws of South Africa. All disputes must be resolved within South African jurisdiction.
Acceptance
By continuing to use FieldFlow OS, you agree to all terms, policies, and conditions contained in this Legal Blueprint. If you do not agree, you must stop using the platform immediately.
